These Terms of Service (“Terms”) govern your access to and use of the PsyberSec website, its content, features, and tools. By accessing or using PsyberSec, you agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, and our Disclaimer. If you do not agree to these Terms, you must not use the website.

1. Acceptance of Terms

By creating an account, browsing, or otherwise using PsyberSec, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable policies referenced herein. These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and PsyberSec (“we,” “us,” or “our”).

If you are accessing the website on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. PsyberSec reserves the right to modify these Terms at any time, as described in Section 14.

2. User Account Registration and Notification of Policies

a) Account Creation

To access certain features of PsyberSec, including the CPE Tracker, you must create an account by providing a valid email address and password, or by authenticating through a supported third-party provider (Google or LinkedIn). Account registration is currently available by invitation only. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

b) Notification of Legal Policies at Sign-Up

At the time of account registration, users are notified of and asked to acknowledge the following policies through an explicit consent checkbox on the sign-up form:

  • Terms of Service (this document) — Governing the conditions of use.
  • Privacy Policy — Describing how personal data is collected, used, stored, and protected.
  • Cookie Policy — Explaining the cookies used on the site and your consent choices.
  • Disclaimer — Setting out the limitations of the website's content and tools.

c) Recommended Method of Notification

PsyberSec employs the following approach to ensure transparent notification and informed consent at the point of registration:

Explicit Consent Checkbox (Required)

The sign-up form includes an unchecked-by-default checkbox requiring the user to confirm: “I have read and agree to the Terms of Service, Privacy Policy, Cookie Policy, and Disclaimer.” Each policy name is linked to the respective page. Account creation is blocked until this checkbox is selected, ensuring affirmative consent as required by GDPR Article 7 and recommended under CCPA best practices.

Cookie Consent Banner (Automatic)

Independently of the sign-up form, all visitors (including those creating accounts) are shown a non-intrusive cookie consent banner on their first visit. The banner provides granular control over cookie categories and links to the full Cookie Policy. This operates separately from the account registration flow and is governed by Section 8 of these Terms.

Confirmation Email (Post-Registration)

Upon successful email-based registration, users receive a verification email that includes links to all four legal documents (Terms of Service, Privacy Policy, Cookie Policy, and Disclaimer) for future reference.

d) Account Responsibilities

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are solely responsible for safeguarding your password. You agree to notify PsyberSec immediately of any unauthorized access to or use of your account. PsyberSec shall not be liable for any loss arising from unauthorized use of your account.

e) Account Termination

PsyberSec reserves the right to suspend or terminate your account at any time if you violate these Terms. You may also request deletion of your account at any time by contacting us through our contact page. Upon termination or deletion, your personal data will be handled in accordance with the data retention provisions in our Privacy Policy.

3. Scope of Service

PsyberSec provides educational content and tools in the fields of cybersecurity, psychology, and digital privacy. The website includes, but is not limited to:

  • Articles, guides, and analyses on cybersecurity and psychology topics
  • A CPE (Continuing Professional Education) Tracker for self-reporting professional development activities
  • User profile and account management features
  • Community features such as comments and discussions

4. CPE Tracker

PsyberSec is not an accredited educational institution. Use of the CPE Tracker does not guarantee acceptance of credits by third-party certifying bodies (e.g., ISC2, ISACA).

The CPE Tracker is a self-reporting organizational tool designed to help you log and manage your professional development activities. It does not constitute an official record of continuing education. You are solely responsible for verifying that any activities you log meet the specific requirements of your certifying body. PsyberSec bears no liability for credits that are rejected, disputed, or not recognized by any external organization. For more information, see Section 3 of our Disclaimer.

5. User Content

You may submit content to PsyberSec, including comments, CPE activity entries, and profile information (“User Content”). By submitting User Content, you represent and warrant that:

  • You own or have the necessary rights to submit the content
  • The content does not infringe on any third party's intellectual property or privacy rights
  • The content is accurate and not misleading
  • The content does not contain malicious code, hate speech, or illegal material

You retain ownership of your User Content. By submitting it, you grant PsyberSec a non-exclusive, royalty-free, worldwide license to use, display, and distribute the content solely in connection with operating the website. PsyberSec reserves the right to remove any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.

6. Prohibited Conduct

When using PsyberSec, you agree not to:

  • Use the website for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the website, its servers, or databases
  • Interfere with or disrupt the integrity or performance of the website
  • Upload or transmit viruses, malware, or other harmful code
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity
  • Scrape, crawl, or use automated tools to extract content from the website without prior written consent
  • Circumvent or attempt to circumvent any security measures, including authentication or cookie consent mechanisms
  • Use the website to harass, abuse, or harm another person

Violation of these restrictions may result in immediate account suspension or termination, at our sole discretion.

7. Intellectual Property

All original content on PsyberSec, including text, graphics, logos, icons, images, audio, video, and software, is the intellectual property of PsyberSec or its content creators and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without prior written permission, except as permitted under fair use or similar doctrines in your jurisdiction.

The PsyberSec name, logo, and all related marks are trademarks of PsyberSec. You may not use these marks without prior written consent.

8. Privacy, Data, and Cookie Consent

Your privacy is important to us. By using PsyberSec, you acknowledge that your personal information will be processed in accordance with our Privacy Policy, which describes the types of information we collect, how we use and store it, and your rights under the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).

a) Cookie Consent

PsyberSec uses essential cookies (always active) for core functionality, including authentication and storing your consent preferences, and non-essential cookies (analytics and functional) that are set only with your explicit opt-in consent. On your first visit, a cookie consent banner is displayed that allows you to accept all cookies, decline non-essential cookies, or customize your choices by category. Full details of every cookie we use are documented in our Cookie Policy.

b) Consent Preference Storage and Expiration

Your cookie consent preferences are stored in your browser's localStorage for exactly 1 year from the date you set them. Each record includes a consent date and a computed expiry date. On every page load, PsyberSec checks whether the stored preferences have expired; if so, they are automatically deleted and you are asked to re-confirm your choices. This ensures ongoing compliance with GDPR Article 7(4) and CCPA Section 1798.135.

c) Withdrawing Consent

You may withdraw or modify your cookie consent at any time by clicking the cookie preferences icon in the bottom-left corner of any page, selecting “Manage Cookies” in the site footer, or visiting the Cookie Policy page. Changes take effect immediately. Withdrawal of consent does not affect the lawfulness of processing performed before withdrawal.

d) Browser Privacy Signals

PsyberSec honors Do Not Track (DNT) and Global Privacy Control (GPC) browser signals. If your browser transmits either signal, we automatically default to essential-only cookies without displaying a consent banner.

e) Your Data Rights

You may exercise your rights under the GDPR (access, rectification, erasure, restriction, portability, withdrawal of consent) and the CCPA (right to know, delete, opt-out, non-discrimination) by visiting our Privacy Policy or contacting us. We will respond within the timeframe required by applicable law.

9. Third-Party Services and Links

PsyberSec uses third-party services for authentication (Supabase, Google, LinkedIn), hosting (Vercel), and analytics (Vercel Analytics, when consented). Each third-party service has its own privacy policy and terms of use. We are not responsible for the practices of these third-party providers.

This website may also contain links to external websites or resources. We do not control, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. The inclusion of a link does not imply endorsement by PsyberSec. For more details, see Section 4 of our Disclaimer.

10. Limitation of Liability

To the fullest extent permitted by applicable law, PsyberSec and its operators shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or relating to:

  • Your use of, or inability to use, the website or any of its features
  • Any errors, omissions, or inaccuracies in the content
  • Any unauthorized access to or use of our servers or personal information
  • Any loss of data, revenue, profits, or business opportunities
  • Any third-party conduct, content, or services accessed through the website
  • Any reliance on CPE Tracker data for certification purposes

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other legal theory, even if PsyberSec has been advised of the possibility of such damage. For the complete limitation of liability statement, see Section 7 of our Disclaimer.

11. Disclaimer of Warranties

The website is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. PsyberSec does not warrant that the website will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

12. Indemnification

You agree to indemnify, defend, and hold harmless PsyberSec, its operators, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the website, your violation of these Terms, or your infringement of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from or relating to these Terms or your use of the website shall be submitted to the jurisdiction of the courts in the relevant jurisdiction. Before initiating formal proceedings, you agree to attempt to resolve any dispute informally by contacting PsyberSec through our contact page.

14. Changes to These Terms

PsyberSec reserves the right to modify these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page. If changes materially affect your rights or obligations, we will provide notice through one or more of the following methods:

  • A prominent banner or notification on the website
  • An email to the address associated with your account (for registered users)
  • A notice on the login page prior to sign-in

Your continued use of the website after the revised Terms become effective constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the website and may request deletion of your account.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
